What This Privacy Policy Covers
This privacy policy covers the use of the web site located at www.jackartgallery.com and the services provided by Artmatch Incorporated. ("Jack"), including how Jack treats personal information that Jack collects and receives. Pursuant to Jack's Terms of Use, you must be 18 years and older to use this site or have permission from a legal guardian. Therefore, this policy makes no provision for individuals under 18 years old. Information Collection and How it is Used
Jack does not collect your personal information when creating an account with us. To set up an account with Jack, and join the community, you simply log in with your existing Facebook, Twitter, Gmail, or other account login. Your personal information is stored with those entities.Administrative Messages
Jack may periodically email you with administrative messages. Jack will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. Your information may be combined with information Jack collects from other companies and used to improve and personalize services, content and advertising. We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to your personally identifiable information. The use of cookies by our third party tracking partners is not covered by our privacy statement. When you post a message, your Jack ID or alias is visible to other users. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. Jack may be required to disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Jack's Terms of Use. Jack may disclose personally identifiable information to parties in compliance with Jack's Copyright and Intellectual Property Policy, as Jack in Jack's sole discretion believes necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, Jack may disclose name, street address, city, state, zip code, country, phone number, email address and company name. Jack may share aggregated demographic information with business partners.Jack employs other companies and people to perform tasks on our behalf and needs to share your information with them to provide products and services to you. Examples include but are not limited to fulfilling orders, handling billing disputes and collections, analyzing data, providing marketing assistance and providing customer service.
Jack will not rent, sell, or share personal information about you with nonaffiliated parties except as specified in this Privacy Policy to provide products or services you have requested or when Jack has your permission. In some cases, Jack may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that is transferred. Jack will transfer information about you if Jack is acquired by or merged with another company. In this event, Jack will notify you by email or by putting a prominent notice on the Jack web site before information about you is transferred and becomes subject to a different privacy policy.
As part of the buying and selling process, you may obtain another Jack user's email address, shipping address and/or other information. Pursuant to Jack's Terms of Use, you have a limited license to use this information. This information should only be used for Jack-related communications or for Jack-facilitated transactions. Jack has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any Jack user to your email or physical mail list.
Without limiting the above, in an effort to respect your privacy and Jack's ability to keep the community free from bad actors, Jack will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order, legal process, or substantially similar legal procedure, except when Jack believes in good faith that the disclosure of information is necessary to protect Jack's rights, prevent imminent physical harm or financial loss, or to report suspected illegal activity.
